By accessing or using Vengl ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access our service.

2. Eligibility & Age Verification

You must be at least 18 years old to use Vengl. By using our service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the service under applicable laws
• You will comply with these Terms and all applicable laws and regulations

Age Verification Process

To ensure all users meet our age requirement:

• You must provide your date of birth during registration
• We may request additional age verification if your account is flagged
• Suspected underage accounts will be immediately suspended pending verification
• If we determine you are under 18, your account will be permanently deleted
• We report suspected minors to appropriate authorities when required by law

3. Account Registration

To use Vengl, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use

4. User Conduct & Content Standards

You agree not to engage in any of the following prohibited activities:

• Upload or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of privacy
• Upload sexually explicit images or content
• Impersonate any person or entity or misrepresent your identity
• Use the service for commercial solicitation or advertisements
• Harass, stalk, or harm other users
• Use automated scripts or bots to access the service
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service or servers
• Violate any applicable laws or regulations

5. Content Moderation & Safety

We employ automated content moderation powered by AI to maintain a safe environment. By using Vengl, you acknowledge that:

• Your content may be reviewed by automated systems
• Content violating our guidelines will be blocked or removed
• Repeated violations may result in account suspension or termination
• We reserve the right to remove any content at our discretion

6. Privacy & Data Usage

Your use of Vengl is also governed by our Privacy Policy. By using our service, you consent to:

• The collection and use of your data as described in our Privacy Policy
• The processing of your connected platform data (Spotify, Reddit, etc.) for matching purposes
• The display of your matching traits to other users

7. Subscription & Payments

Vengl offers both free and paid subscription tiers:

• Free Tier: Limited messaging and basic features
• Premium Tier ($9.99/month): Unlimited messaging and advanced features
• VIP Tier ($19.99/month): Priority features and premium perks

Subscriptions automatically renew unless cancelled. You may cancel anytime through your account settings.

8. Intellectual Property & Content Licensing

The Vengl service, including all content, features, and functionality, is owned by Vengl and protected by international copyright, trademark, and other intellectual property laws.

Your Content License to Us

By uploading content to Vengl, you:

• Retain ownership of your content
• Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content
• Authorize us to show your photos and profile to other users for matching purposes
• Allow us to store and backup your content on our servers
• Permit us to create derivatives (thumbnails, cropped versions) for service functionality
• Warrant that you own or have rights to all content you upload
• Confirm no third parties have rights that would prevent our use

This license continues until you delete your content or account, except as needed for backups and legal compliance.

DMCA Copyright Policy

We respect intellectual property rights. If you believe content infringes your copyright:

• Send a DMCA notice via our Help Center
• Include: description of copyrighted work, URL of infringing content, your contact info
• We will promptly investigate and remove infringing content
• Repeat infringers will have their accounts terminated

9. Third-Party Services

Vengl integrates with third-party services (Spotify, Last.fm, Apple Music, Reddit, Steam, Discord, Twitch, Goodreads, Letterboxd). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability or accuracy of third-party services.

10. Disclaimers & Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Background Checks or Sex Offender Screening

IMPORTANT: Vengl does NOT conduct criminal background checks on users or screen against sex offender registries. You are solely responsible for:

• Taking precautions in your interactions with other users
• Conducting your own research and due diligence
• Checking public records and sex offender registries yourself
• Meeting in public places and informing others of your plans
• Trusting your instincts and leaving if uncomfortable

We do not make any representations or warranties about user backgrounds or criminal history. You interact with other users at your own risk.

Dating Risks

You acknowledge that dating involves inherent risks. Vengl is not responsible for:

• The conduct of any user on or off the platform
• Any physical, emotional, or financial harm from user interactions
• False information provided by other users
• Identity theft, stalking, or harassment

IN NO EVENT SHALL VENGL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Vengl, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of the service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Conduct that we believe is harmful to other users or the service
• At our sole discretion

Upon termination, your right to use the service will cease immediately.

13. Dispute Resolution & Class Action Waiver

Any disputes arising from these Terms or your use of Vengl shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Toronto, Ontario, Canada.

Class Action Waiver

YOU AND VENGL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Vengl agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the service. Your continued use of Vengl after such modifications constitutes acceptance of the updated Terms.

16. Account Verification

While we don't currently offer profile verification badges, we reserve the right to:

• Implement photo or identity verification in the future
• Request verification for accounts suspected of impersonation
• Display verification status on user profiles
• Prioritize verified profiles in matching algorithms

17. App Store Compliance

If you download Vengl from an app store (Apple App Store, Google Play Store), you acknowledge:

• These Terms are between you and Vengl, not the app store provider
• The app store provider has no obligation to provide support or maintenance
• The app store provider is not responsible for any claims or liabilities
• You must comply with the app store's terms of service
• The app store provider is a third-party beneficiary with rights to enforce these Terms

18. International Use

Vengl is operated from Canada. If you use the service from other countries:

• You are responsible for compliance with local laws
• You consent to data transfer to Canada
• Some features may not be available in your jurisdiction
• We may restrict access from certain countries

19. Accessibility

Vengl is committed to making our service accessible to all users:

• We strive to meet WCAG 2.1 Level AA standards
• Our app is compatible with screen readers
• We provide alternative text for images where possible
• We use sufficient color contrast for readability
• Report accessibility issues via our Help Center
